WILD: A Berkeley chemical engineer who allegedly spent nearly 18 months secretly poisoning a coworker’s food and water with cadmium, a highly toxic heavy metal, avoided prison despite initially facing a potential life sentence.
The victim endured years of mysterious health problems, including episodes severe enough to require emergency hospital treatment. Desperate to uncover the cause, she purchased a hidden surveillance camera from Amazon and installed it in her workplace.
The camera captured disturbing footage in 2019 appearing to show her coworker, David Xu, slipping a substance into her water bottle.
Xu was arrested that year and charged with attempted murder and two counts of poisoning, potentially exposing him to life behind bars.
However, prosecutors ultimately dropped the attempted murder charge and one poisoning count as part of a plea agreement. Xu pleaded no contest to a single felony poisoning charge and received just two years of probation, with credit for one day already served.
After completing probation in March, Xu is now seeking to have his felony conviction dismissed.
Despite the serious allegations and the victim’s prolonged suffering, Xu served no additional jail time.
